Freight broker license requirements

There is no exam and no certificate. There is a filing, a bond, a process agent, and a wait.

People search for a freight broker license expecting something like a real estate license: study, sit an exam, get a certificate. That is not how this works.

What you are actually getting is operating authority from the Federal Motor Carrier Safety Administration. It is granted based on filings and financial responsibility, not on a test.

The four requirements

1. A legal business entity. An LLC or corporation registered in your state, with an EIN. Sole proprietors can technically file but almost nobody should, because brokering carries real liability.

2. Broker operating authority (MC number). Filed via the OP-1 form through the FMCSA Unified Registration System. The filing fee is $300 and it is non-refundable. Make sure you select broker authority for property, not motor carrier authority.

3. A $75,000 surety bond or trust fund. Form BMC-84 for a bond, BMC-85 for a trust. Almost everyone uses the bond. You pay an annual premium, not the full amount.

4. Process agents in every state you operate. Form BOC-3. Buy a blanket national filing from a process agent service for roughly $50 to $100 and they file it for you.

The real timeline

Stage Duration
Entity and EIN 1 to 3 days
OP-1 filing submitted Same day
FMCSA assigns pending MC number 1 to 3 days
Public protest period 10 business days
Bond and BOC-3 processed Concurrent with the above
Authority granted and active 3 to 6 weeks total

The protest period is fixed and you cannot pay to skip it. Everything else is only as fast as you are.

What can delay you

  • Name mismatch. The entity name on your OP-1 must exactly match your state registration. A missing "LLC" causes a rejection.
  • Bond filed late. Your authority will not activate until the surety files the BMC-84 electronically with FMCSA. Ask your surety to confirm they filed, do not assume.
  • Bad credit on the bond application. If underwriting takes a week, your whole timeline slides a week.
  • Missing BOC-3. This is the one people forget entirely, and it silently holds up the grant.

What the license does not include

Insurance. General liability and contingent cargo coverage are not federally required for brokers, but you will not sign a shipper without a certificate, so treat them as required in practice.

It also does not include anything about running the business. No customers, no carriers, no rates, no contracts. The license is permission to operate, nothing more.

Do you need to renew it?

Your authority does not expire, but two things keep it alive. Your surety bond must stay in force continuously, and you must file a biennial update, the MCS-150, every two years. Let the bond lapse and FMCSA will revoke your authority, which means refiling and paying the $300 again.

The trap

The license feels like the finish line and it is the starting line. Plenty of people hold active broker authority and have never moved a load, because getting the paperwork right is a project with a checklist and getting a customer is a habit with no end date.

Common questions

Is there a freight broker license exam?

No. The FMCSA grants broker authority based on filings and financial responsibility, not a test. There is no federal exam and no certificate you have to earn first.

How much does a freight broker license cost?

The FMCSA filing fee is $300. Add a surety bond premium of $900 to $3,000 a year, process agents at $50 to $100, and your state entity fee. Realistically $1,300 to $4,000 to get active.

How long does it take to get freight broker authority?

Three to six weeks from filing to active, including a mandatory 10 business day protest period. The most common delays are a name mismatch on the OP-1 and a surety bond that gets filed late.

Does a freight broker license expire?

Authority itself does not expire, but it is revoked if your surety bond lapses. You also have to file an MCS-150 biennial update every two years to stay in good standing.
